Section 1 Scope, provider
(1) These General Terms and Conditions (T&Cs) apply to all contracts for the purchase of goods between MEISTER EDE GUITARS, owner Edin Čolić, Vorm Eickerberg 3, 42929 Wermelskirchen, Germany (hereinafter “we”), and our customers. The version valid at the time the contract is concluded shall apply.
(2) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (Section 13 of the German Civil Code, BGB). A trader is any natural or legal person or partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their trade, business or profession (Section 14 BGB).
(3) Deviating terms of the customer shall only apply if we have expressly agreed to them.
(4) Instruments that we offer on behalf of third parties (on commission) are sold in our own name. These T&Cs apply to them without restriction; in every case, your contractual partner is MEISTER EDE GUITARS.
(5) For purchases made via platforms such as Reverb or Kleinanzeigen, the terms of the respective platform apply in addition.
Section 2 Conclusion of the contract
(1) The presentation of instruments on our website does not constitute a legally binding offer, but an invitation to you to make an enquiry.
(2) Your enquiry by e-mail, phone or contact form is non-binding. We will then send you a binding offer by e-mail, usually in the form of an invoice containing all details of the instrument, price, shipping costs, payment method and delivery time.
(3) The contract is concluded when you accept this offer within the period stated in it, either by confirming it by e-mail or by paying the invoice amount.
(4) In the case of a purchase on site in Wermelskirchen, the contract is concluded when agreement on the purchase is reached.
(5) The language of the contract is German. You will receive the contract text (offer or invoice) by e-mail; we also store it in accordance with the statutory retention obligations.
Section 3 Prices and shipping costs
(1) All prices stated are final prices and include statutory VAT.
(2) We sell used instruments predominantly under the margin scheme pursuant to Section 25a of the German VAT Act (UStG). In this case, VAT is included in the price but is not shown separately on the invoice; traders cannot deduct input tax. All other items, including some used instruments, are sold under standard taxation with 19 % VAT shown separately. We will gladly tell you in advance which taxation applies to an instrument; it is also stated in the offer and on the invoice.
(3) Shipping costs may be added. We will state them in the offer before the contract is concluded. No shipping costs apply for collection on site.
Section 4 Payment
(1) You can pay as follows:
a) Advance payment by bank transfer: you transfer the invoice amount to the account stated on the invoice. The item is shipped once payment has been received.
b) Cash payment on collection on site by appointment.
c) PayPal: only in exceptional cases and by prior arrangement.
(2) The purchase price is due upon conclusion of the contract.
(3) You shall only be entitled to set-off if your counterclaims have been legally established, are undisputed or have been acknowledged by us. You may only exercise a right of retention insofar as your counterclaim is based on the same contractual relationship.
Section 5 Delivery, collection and passing of risk
(1) We deliver within Germany and to all member states of the European Union. Shipping is carried out by DHL. If you are a trader, you may request transport insurance covering the full value of the goods; we will state the costs for this in the offer.
(2) The delivery time within Germany is up to 7 working days after receipt of payment. For deliveries to other EU countries, we will state the delivery time in the offer.
(3) By appointment, you can also view and collect the instrument at our premises in Wermelskirchen.
(4) If you are a consumer, the risk of accidental loss and accidental deterioration of the goods only passes to you upon handover to you. If you are a trader, the risk passes to you upon handover to the carrier.
(5) If instruments are delivered with obvious transport damage, we ask you to report such damage to the carrier immediately if possible and to inform us. This does not affect your statutory rights; the request merely enables us to assert our own claims against DHL or the insurer.
Section 6 Retention of title
The goods remain our property until paid for in full.
Section 7 Right of withdrawal
(1) Consumers have a statutory right of withdrawal for contracts concluded exclusively by means of distance communication (e.g. e-mail, phone). The details are set out in the withdrawal policy below.
(2) There is no statutory right of withdrawal for contracts concluded in the simultaneous physical presence of you and us at our premises (purchase on site).
(3) Traders have no right of withdrawal.
Section 8 Warranty and condition of the instruments
(1) The statutory rights in respect of defects apply unless otherwise provided below.
(2) Many of our instruments are used, aged (relic/aged) or vintage instruments. Signs of use, ageing and storage, as well as previous repairs or modifications, that are stated in the item description, shown in the photos or mentioned in the offer do not constitute a defect. With regard to consumers, this only applies if you were specifically informed of them before the contract was concluded and these deviations were expressly and separately agreed (Section 476(1) sentence 2 BGB). We do this by means of a separate confirmation in the offer.
(3) For new goods, the limitation period for claims for defects is two years from delivery with regard to consumers. For used goods, it is one year from delivery with regard to consumers, provided this was specifically communicated and expressly and separately agreed before the contract was concluded (Section 476(2) BGB); otherwise, two years also apply.
(4) With regard to traders: liability for defects is excluded for used goods. For new goods, the limitation period is one year from delivery. Traders who are merchants must give notice of defects without delay in accordance with Section 377 of the German Commercial Code (HGB).
(5) The reductions and exclusions under paragraphs 3 and 4 do not apply to claims for damages under Section 9, nor where we have fraudulently concealed a defect or given a guarantee as to the quality of the goods.
(6) Manufacturer’s guarantees (e.g. for new goods) apply in addition to your statutory rights and are governed by the terms of the respective manufacturer.
Section 9 Liability
(1) We accept unlimited liability for damage resulting from injury to life, body or health, for damage caused intentionally or through gross negligence, under the German Product Liability Act and to the extent of any guarantee given.
(2) In the event of a slightly negligent breach of a material contractual obligation (obligations whose fulfilment is essential to the proper performance of the contract and on whose observance you may regularly rely), our liability is limited to the foreseeable damage typical for this type of contract.
(3) Otherwise, liability for slight negligence is excluded.
Section 10 Dispute resolution
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
Section 11 Final provisions
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident in another country, you retain the protection afforded by the mandatory provisions of the law of that country.
(2) If you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from this contract is our place of business in Wermelskirchen.
(3) Should individual provisions of these T&Cs be invalid, the validity of the remaining provisions shall remain unaffected.
Withdrawal policy
Consumers have a right of withdrawal in accordance with the following provisions:
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period will expire after fourteen days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.
To exercise the right of withdrawal, you must inform us (MEISTER EDE GUITARS, owner Edin Čolić, Vorm Eickerberg 3, 42929 Wermelskirchen, Germany, phone: +49 172 2972245, e-mail: Info@MeisterEdeGuitars.com) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail). You may use the attached model withdrawal form, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.
You will have to bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
