1. Controller
The controller responsible for data processing on this website is:
MEISTER EDE GUITARS, owner: Edin Čolić
Vorm Eickerberg 3, 42929 Wermelskirchen, Germany
E-mail: Info@MeisterEdeGuitars.com · Phone: +49 172 2972245
2. Hosting
This website is hosted by Cloudflare and delivered through the Cloudflare network. The provider is Cloudflare, Inc., 101 Townsend St., San Francisco, CA 94107, USA. On our behalf, Cloudflare processes the data that arises technically when the website is accessed (see section 3) in order to deliver the pages and protect them against attacks and misuse. The legal basis is our legitimate interest in providing our website quickly, securely and reliably (Art. 6(1)(f) GDPR).
We have a data processing agreement with Cloudflare under Art. 28 GDPR (Cloudflare's Data Processing Addendum). Data may also be transferred to the USA. Cloudflare, Inc. is certified under the EU-US Data Privacy Framework, for which the European Commission has issued an adequacy decision. Should this certification lapse, the EU Standard Contractual Clauses agreed in the contract apply. Further information: Cloudflare privacy policy.
3. Server log files
When you access this website, information transmitted by your browser is recorded automatically: browser type and version, operating system used, referrer URL, host name of the accessing computer, time of the server request and IP address. This data serves the technical provision and security of the website. The legal basis is our legitimate interest in the secure and error-free operation of the website (Art. 6(1)(f) GDPR). This data is not combined with other data sources.
We do not store any server log files ourselves and do not analyse access data. Cloudflare processes this data only to deliver and secure the website and deletes it as soon as it is no longer required for these purposes. You may object to this processing (see section 10).
4. Contacting us
If you contact us by e-mail, phone or via the contact form, we process your details in order to handle your enquiry. Where your enquiry concerns a purchase or relates to a contract, the legal basis is Art. 6(1)(b) GDPR (pre-contractual measures or performance of a contract); in all other cases, it is our legitimate interest in responding to enquiries (Art. 6(1)(f) GDPR). We do not pass this data on without your consent.
Our contact form does not transmit any data to us on its own: it merely opens your own e-mail program with a prepared subject line and message. The data you enter remains on your device until you send the e-mail yourself.
We delete your enquiry once it has been fully dealt with and no contract results from it. If a purchase follows, the retention periods in section 5 apply.
5. Purchases and order processing
When you buy an instrument from us, we process the data required for this purpose: name, address, e-mail address, phone number, details of the item purchased and payment information. The legal basis is the performance of the purchase contract (Art. 6(1)(b) GDPR).
Payment
With cash payment on collection, no payment data is passed on to third parties. With bank transfer, our bank processes the payment data (name, account details, amount, payment reference). In exceptional cases, payment via PayPal is possible; the provider is PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg. PayPal also processes your data under its own responsibility; see the PayPal Privacy Statement.
Shipping
We ship with DHL (Deutsche Post AG / DHL Paket GmbH, Sträßchensweg 10, 53113 Bonn, Germany). For this purpose, we pass your name and delivery address on to DHL (Art. 6(1)(b) GDPR). We also pass your e-mail address on to DHL so that DHL can notify you about the shipment and you can track your parcel. The legal basis is our legitimate interest in the reliable, traceable delivery of valuable instruments (Art. 6(1)(f) GDPR). If you do not want this, simply let us know before the item is shipped; you may object to this transfer at any time (see section 10). We only pass on your phone number if this is required for delivery.
Purchases via Reverb and Kleinanzeigen
We also offer instruments via Reverb and Kleinanzeigen (formerly eBay Kleinanzeigen). The use of these platforms is subject to their own privacy policies. We process any data we receive from you there in connection with a purchase as described in this section.
Retention period
We store contract data for as long as we need it to process the contract and to meet statutory warranty obligations. In addition, we retain invoices and accounting records in accordance with the retention obligations under German commercial and tax law (Section 257 HGB, Section 147 AO) for up to ten years (Art. 6(1)(c) GDPR). The data is then deleted.
6. Cookies and local storage
Cookies are small text files stored on your device. In its basic function, this website works without any cookies requiring consent. Should analytics or marketing services be used in future, we will obtain your consent beforehand.
If you mark instruments using the heart symbol ("I like this"), this selection is stored solely in your browser's local storage. This information never reaches our server, is not transmitted to third parties, and can be deleted at any time by clearing your browser data. It serves your convenience alone. As it is only stored when you use this function yourself, no separate consent is required under Section 25(2) No. 2 TDDDG.
7. Fonts
All fonts used on this website are stored on our own server and delivered from there. No connection to Google servers or any other external font provider is established, and your IP address is therefore not transmitted to such providers.
8. Videos (YouTube)
Some product pages embed videos from our YouTube channel. These videos load only after you actively click on them; only at that point is a connection to YouTube (Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland) established and your IP address transmitted. Until then, only a preview image stored on our own server is displayed. We use the extended data protection mode (youtube-nocookie.com).
By clicking on the video, you consent to this data transfer (Art. 6(1)(a) GDPR, Section 25(1) TDDDG). Your consent applies only to the video concerned and the current page visit. Data may also be transferred to Google LLC in the USA. Google LLC is certified under the EU-US Data Privacy Framework, for which the European Commission has issued an adequacy decision. Further information: Google Privacy Policy.
9. SSL/TLS encryption
For security reasons, this site uses SSL/TLS encryption. You can recognise an encrypted connection by the "https://" in the address bar.
10. Your rights
You have the right at any time to obtain free information about your stored personal data (Art. 15 GDPR), and the rights to rectification (Art. 16 GDPR), erasure (Art. 17 GDPR), restriction of processing (Art. 18 GDPR) and data portability (Art. 20 GDPR). You may withdraw any consent given at any time with effect for the future, informally by e-mail (Art. 7(3) GDPR).
You also have the right to lodge a complaint with a data protection supervisory authority (Art. 77 GDPR). The authority responsible for us is: Landesbeauftragte für Datenschutz und Informationsfreiheit Nordrhein-Westfalen, Kavalleriestraße 2–4, 40213 Düsseldorf, Germany, www.ldi.nrw.de.
